MANUFACTURED HOUSING PRACTICE GROUP

Since the early 1990’s, Pullin, Fowler, Flanagan, Brown & Poe, PLLC has been extensively involved in representing major manufacturers and retailers of manufactured homes and modular homes. This representation has involved the defense of claims alleging fraud, improper set-up and installation, negligent transportation, breach of expressed warranty, breach of implied warranty, Uniform Commercial Code, the HUD Code, Magnuson & Moss and Truth-In-Lending. Our Manufactured Housing Practice Group has represented manufactured housing manufacturers and retailers before the West Virginia Manufactured Housing Safety and Construction Standards Board of the West Virginia Division of Labor and in both Federal and State courts throughout West Virginia.

It is a goal of Pullin, Fowler, Flanagan, Brown & Poe, PLLC to provide effective risk management counsel to our clients to assist them in avoiding violations of the numerous HUD regulations and State regulations that govern the business of manufactured and modular housing. Our Manufactured Housing Practice Group has been involved in drafting industry forms involving disclosure issues and in preparing mediation and arbitration forms for the finance and insurance managers. This practice group has also been involved in the creation of legislation specifically designed to provide tort reform and to protect the manufactured housing industry from frivolous lawsuits.

We work extensively with the West Virginia Manufactured Housing Institute. Our firm speaks yearly at the annual meeting of the West Virginia Manufactured Housing Institute on various issues specific to manufactured housing law.
